County jails hold people before trial or for short sentences. State prisons hold people convicted of felonies with sentences over one year. Florida Booking Photo Access Rules

Florida has strong public records laws that cover mugshots and arrest records. Under Chapter 119 of the Florida Statutes, all state, county, and municipal records are open for personal inspection and copying. Booking photos fall under this law. Section 119.01 says that providing access to public records is a duty of each agency. The law also says that automation of records must not erode the right of access. This means that as Florida agencies put records online, they still have to let people inspect and copy them the old way too. You can request mugshots and arrest records in person, by phone, by mail, or online in Florida. You do not have to give your name. You do not need to state a reason for the request.

This law is the base for public access to Florida busted mugshots and arrest records. There are a few exceptions worth knowing. Section 119.071(4)(d) exempts photos of active or former law enforcement officers from public release. If a law enforcement officer gets arrested in Florida, their mugshot can be withheld if they or their agency files a written request for confidentiality. This exemption covers home addresses, phone numbers, and photos of officers and their families.

The opinion confirmed that Florida agencies can withhold officer mugshots when a written confidentiality request is on file. Victim information also has limits under Florida Section 119.071(4)(h). Photos of sexual offense victims are confidential. Police reports are public records under Florida Section 119.105, but exempt info cannot be used to solicit crime victims.

Seal and Expunge Florida Mugshots

If you have a Florida arrest record or mugshot you want removed, the process goes through FDLE. Section 943.0585 of the Florida Statutes allows court-ordered expungement. When a record is expunged, it gets physically destroyed or obliterated from public databases. FDLE keeps a confidential copy for limited purposes, but the public record is gone. Section 943.059 allows court-ordered sealing, which is different. A sealed record gets placed under seal and is not available to the public. Courts and the criminal justice system can still see it. Section 943.0581 covers administrative expungement, and Section 943.0582 covers juvenile diversion expungement in Florida. Each type has its own rules and required forms.
