Under Florida Statute Chapter 119, you do not have to give your name or explain why you want the records. Jacksonville Mugshots and Florida Law
Florida has some of the strongest public records laws in the country. Booking photos taken during an arrest in Jacksonville are public records under Chapter 119 of the Florida Statutes. This means anyone can request them. You do not need to be a lawyer, journalist, or relative of the person arrested. The law says providing access is a duty of each agency, and automation should not erode that right.
There are some limits though. Under Section 119.071(4)(d), photographs of active or former law enforcement officers are exempt from public disclosure. If an officer was arrested in Jacksonville and filed a written request, JSO could withhold that booking photo. The exemption also covers home addresses, phone numbers, and social security numbers of law enforcement personnel and their families. A case called Fraternal Order of Police v. City of Jacksonville dealt with this exact issue in Duval County and found that JSO could not release a deputy's booking photo when confidentiality was requested.
Victim info is protected too. Section 119.071(4)(h) makes photographs of sexual offense victims confidential. And Section 119.105 says police reports are public records, but exempt information in those reports cannot be used for commercial solicitation of crime victims in Jacksonville or anywhere else in Florida.
Expunging Jacksonville Mugshots
If you were arrested in Jacksonville and the case was dropped or you were found not guilty, you may be able to get your mugshot and arrest record sealed or expunged. These are two different things. Sealing puts the record under seal so the general public cannot see it, but courts and law enforcement still can. Expunging means the record is physically destroyed or removed from the system.
Both processes go through the Florida Department of Law Enforcement. You need to apply with FDLE's Seal and Expunge Section. The fee is $75, paid by money order to FDLE. One thing to keep in mind is that sealing or expunging your Jacksonville arrest record does not remove copies from private mugshot websites. Those sites are not required by law to take down photos even after a court order. FDLE and JSO will remove their copies, but anything already published online by a third party may stay up unless you contact those sites directly.
