Miami Mugshots Under Florida Law

Booking photos taken in Miami are public records. That is the default under Florida's public records law. Chapter 119 says all state, county, and municipal records are open for personal inspection. There are a few exceptions though.

Section 119.071(4)(d) exempts photographs of current and former law enforcement officers from public disclosure. If a Miami police officer or county deputy was arrested and filed a written request for confidentiality, the agency can withhold the booking photo. This came up in a case involving the Duval County Sheriff, but the same rule applies across Florida, including Miami-Dade. Photographs of sexual offense victims are confidential under Section 119.071(4)(h). And police reports are generally public, but exempt details in those reports cannot be used for commercial solicitation of victims under Section 119.105.

If you were arrested in Miami and want your mugshot removed from public view, you can apply to have your record sealed or expunged through FDLE. The fee is $75. Processing takes around 12 weeks. Keep in mind that even after sealing or expunging, private websites that already published your Miami mugshot are not required to take it down.

Note: Florida law allows anonymous public records requests, so you never have to explain why you want a Miami mugshot.

Find Miami Booking Records Online

Several statewide databases can help you find Miami arrest records and mugshots beyond what the city police department provides. The Florida Jail Information System pulls booking data from agencies across the state, including Miami-Dade. You can search for currently incarcerated individuals, recently booked people, or persons of interest. The system updates regularly and covers all 67 Florida counties.

The Florida Department of State keeps a directory of every county jail with contact information and links to inmate search tools. For people sentenced to state prison after a Miami arrest, the Florida Department of Corrections Offender Search shows location, status, and identifying details. FDLE also runs a Wanted Persons Database with warrant information from agencies statewide.

Miami Record Request Costs

Copy fees for Miami mugshots follow the standard set by state law. Single-sided copies cost 15 cents per page. Double-sided pages are 20 cents each. Certified copies can cost up to $1.00. If your request is complex and takes significant staff time, the agency may charge a special service fee after the first 30 minutes of free labor. A deposit may be required for estimates that go over $100.

For a statewide criminal history check through FDLE, the fee is $24. Contact FDLE at 850.410.8109 for that service. If you need to seal or expunge a Miami arrest record, the FDLE application fee is $75 by money order. Keep your request specific to save time and money. A name, date, or case number will help the records team in Miami pull what you need faster.
